Agreement to Terms

By creating an account or using jrvaPhotoShare, you represent that you are legally permitted to do so by your local laws and that you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the service.

Service Description

jrvaPhotoShare provides a secure photo sharing platform that allows you to:

• Create photo albums and upload photos
• Share albums with others via secure invite links
• Manage who has access to your photos
• Invite family members and friends to view your albums

jrvaPhotoShare is designed for sharing, not guaranteed archival storage. You are responsible for maintaining your own backups of your photos. You may download a complete backup of all photo albums stored on jrvaPhotoShare at any time, regardless of free or paid account status.

Account Registration and Security

Account Creation

• You must provide a valid email address to create an account
• You must confirm your email address before accessing the service
• You are responsible for maintaining the confidentiality of your password
• You must be at least 13 years of age to use jrvaPhotoShare. Residents of countries other than USA may have a higher minimum age, and in those cases you must be of minimum legal age in your country.

Eligibility and Geographic Availability

jrvaPhotoShare is intended for use in locations in which it is not restricted by law, and by people who may legally use such a service. By creating an account or using the service, you represent and warrant that you are not restricted from using such service, and that your use of jrvaPhotoshare complies with your local and national laws.

We do not represent that jrvaPhotoShare is always appropriate or available for use outside the United States. Access to the service from jurisdictions where it is illegal or restricted is prohibited. We reserve the right to restrict, suspend, or terminate access to the service if we believe it is being used in violation of applicable laws.

Account Security

• You are responsible for all activity under your account
• Notify us immediately of any unauthorized access or security breach
• We may temporarily suspend or permanently terminate accounts that violate these Terms
• Multiple failed login attempts may result in temporary IP blocking for security purposes

Acceptable Use

Permitted Uses

You may use jrvaPhotoShare to:

• Share personal photos with family and friends
• Create and organize photo albums
• Invite others to view your photos via secure links
• Open one free account per user

Prohibited Activities

You may not:

• Upload, store, or distribute child sexual abuse material (CSAM)

Discovered violations will immediately be reported to the U.S. National Center for Missing and Exploited Children (NCMEC) per 18 U.S. Code § 2258A, and the related account will be disabled.

Additionally, you may not:

• Upload illegal, abusive, or clearly harmful content
• Share content that infringes the copyright, privacy, or other rights of others
• Attempt to gain unauthorized access to other accounts or systems
• Use automated systems to scrape, spam, or abuse the service
• Upload malware, viruses, or malicious code
• Harass, threaten, or harm others
• Open multiple free accounts

Content Ownership and Responsibility

Your Content

• You retain full ownership of your photos that you upload
• You grant jrvaPhotoShare a limited, non-exclusive license to store, display, and transmit your content solely as necessary to operate the service
• This license terminates when your content or account is deleted

Content Responsibility

• You are solely responsible for the content you upload
• You represent that you have all rights necessary to upload and share your content
• You must respect the privacy and intellectual property rights of others

Storage and Service Limitations

• Storage limits may apply based on account type
• File size and format restrictions may apply
• Service availability is not guaranteed 24/7
• We may implement reasonable usage limits to maintain system stability and security

Sharing and Invitation Links

• Invitation links expire automatically after a selectable time period
• You control who has access through invitation link management
• Recipients may view and technically may save photos if they know how to
• Once content is shared, recipients may capture, copy, or redistribute it beyond your control
• You may revoke access to your share/invitation links at any time by disabling share links, deleting the album, or deleting your account

Account Termination

By You

• You may delete your account at any time through account settings
• Account deletion is permanent and cannot be undone
• Photos and albums are permanently deleted in a batch operation within two weeks

By Us

We may suspend or terminate your account if:

• You violate these Terms and Conditions
• Your account is used for illegal activities
• You engage in abusive behavior or attacks against the service
• Your account remains inactive for an extended period

Copyright Complaints (DMCA)

If you believe that content hosted on jrvaPhotoShare infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA). We will respond to valid notices and may remove content as required by law.

Disclaimer of Warranties

jrvaPhotoShare is provided "AS IS" without warranties of any kind, either expressed or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Guarantees of absolute data security or backup

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for loss of data, even if advised of the possibility
• You are responsible for maintaining backups of your photos
• Our total liability shall not exceed the amount you paid for the service

Indemnification

You agree to indemnify and hold harmless jrvaPhotoShare from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your use or misuse of the service

Changes to Terms

We may update these Terms and Conditions from time to time:

• The version number and "Last Updated" date will be revised
• Significant changes may require your acceptance upon next login
• Continued use of the service constitutes acceptance of the updated Terms

Governing Law

These Terms are governed by the laws of the United States and the state of Illinois, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
